1. Is it legal to swap from a 3.9 v6 to a 318 v8 for a 1993 dodge dakota? Is it legal for federal and illinois state law?
2. Has anyone done this or know where I can find a step by step manual for converting? I've looked online for such and found nothing.

Man, there is a ton of info on swapping engines in both the GenII daks and the GenIIIs. Just do a search for v8 swap, and you will find some good info on both this site and the other Dakota sites out there.
At a minimum you will need 2 new injectors and wire them into your existing harness. V8 fuel rail, V8 PCM, possible tranny swap. The stock V8 tranny is beefier than the V6 one, although some have run the V6 on a V8 before. You will also need headers or stock manifolds off a V8 and the y-pipe. All the accessories should bolt right up.
