is a set of headers that is mandated as "for off road use only" declared that just because of emissions or is there something else that makes them declared that?

Anything that doesn't meet govt standards for emissions or whatever has to be sold as "off road" only. For example, if you buy brighter headlights 80/100 watt, they will say the same thing. In the case of the headers, emissions is the key.

Yep. Chances are you would still meet standards anyway. It just means they didn't spend the money to do the testing.
