Subject: Overfilled tranny?

I just discovered my auto tranny is overfilled. Purchased my 97 Dakota CC 5.2 2wd from a Dodge dealer about two months ago... I think they changed all the fluids before putting it on the lot (58,000 miles). Fluid looks new, just WAY over filled (quarter to half inch over the "max full hot" marks). Could this affect the shifting characteristics? Could this damage the transmission? Currently the tranny upshifts at 3,900 to 4,100 rpm under full throttle... should run to 5,000 rpm or so, shouldn't it? Any suggestions on how to remove extra fluid without dropping the pan? I also had to max out the TV cable adjustment (toward the firewall) to get it to part throttle shift properly. Would the extra fluid affect this too?
