ALright, So im driving my beater (an '83 rabbit) through town today, and I get pulled over. The cop claims I was doing 33 in a 20.... but it was actually a 25 mph zone. I dont have a speedo, and I was pacing myself with the truck in front of me (he had to have been speeding too).... my question is; since I just picked this car up, and its not even in my name yet... do you think if I fix the speedo, say I didnt have time to fix it yet, and contest it, the judge will either give me some slack because I just got the thing.... or do you think he will drop the fine because it was actually a 25mph zone, and the cop wrote it up wrong? (I was told by a friend that if the officer makes an error like that, they will drop the fine) Yes, I have a dakota for those who are wondering why the hell I am asking about a speeding ticket in a rabbit. Thanks!

If you have the time to go to court, go ahead and try it. You will need a picture of the limit sign in the area you were stopped. If the officer does not show up, you win. Find out what day he is off. They don't like to have to spend their day in court when they could be playing.

Well...your half right about the "cops day off thing", but an appointed officer from the dept. will usualy go down and do "traffic court" all day. Not always the cop that pulled you over will be standing next to you in court. Kinda sucks...but if you have the time..go for it. Ive seen some weird cases dropped.

Well, it's not going to look too good telling the judge you were driving with faulty equipment. You didn't mention that to the officer, did you? That would have been another citation right there. =) I'm not sure how much that'll help you. It ALWAYS pays to show up for your court dates because more often than not, the judge will at least lower the foreiture, points or both. Does the citation state that he said you were in a 20 zone? There should be a box on the citation stating the posted speed and your actual speed. Just like handi2 said, grab a camera and go to the place you were pulled over and take a picture of the speedlimit sign. The police officer doesn't have to be there court. If you plead not guilty, a court date will be scheduled. That's when the officer has to be there.

You were speeding.
You got caught.
Pay the fine.
Don't do it again.
Or continue doing it.
And take your chances.

That's the beauty of our system.
As long as you are willing to pay the price of getting caught you can keep doing it.

But don't try to weasle out of it by whinning about the wrong box checked on a ticket or your speedo doesn't work.

Show some responsibility by admitting your errors and learn from them. It's called growing up! We all do it slowly all of our lives.

You may be able to fight the ticket by claiming
an equipment malfunction. You will have to prove that the speedometer was broken recently, and you had not had time to fix it.
They may let you off from the speeding ticket, but will issue you a citation, which will require you to fix the speeo by a certain date.

Go to court, it will pay in the long run. If he wrote the ticket wrong, then it should be thrown out of court. Especially if you were less than 10mph under the speed limit. They don't like to waste there time with little things like that.

Hey! My brother has been written like 5-7 tickets and only 2 have held in court. Here the ticket can be thrown out for a lot of reasons, officer didn't sign the ticket, officer didn't show up, cop wrote the ticket for a day that the court wasn't open. The judge can drop it without you even having to enter a plea if you bring something like that to his attention. Fight it! That's what's great about our judicial system it has loopholes!

Hmmm.. up here in Washington, the actual cop that wrote you the ticket is subpoenaed. If he doesn't show you're off the hook. As for any other defense, I think you're out of luck. Using the, 'just bought it and the speedo isn't working' bit will probably not work. Assuming the cop shows, the judge will ask you why you didn't have the vehicle towed to a speedo shop to get it fixed.

Friend of mine got off with explaining that the speedo was not working right and proved he got it fixed or had to prove it afterwards---I can't remember, it was 10 years ago....but he won---less the cost of the shop fixing it.
