Subject: Is this possible? IP: Logged
Message: I bought an '02 QC on October 6, with my first payment due November 20. The dealer called today and said I need to come in and sign a new contract, the quoted monthly payment and recorded sales price are a few cents off.
Since Dodge started including a 7 year, 100000 mile warranty on November 1, I think I should get this warranty written into the new contract. What do you think? Is this possible?

The warranty actually goes into effect the moment you take delivery. However, if they have to redo the contract, it means that the original one was not sent to Chrysler - which in turn means that they (Chrysler) don't know you own it. Actually, if you want to get technical, you DON'T own it.
I went through this with my dealership because they screwed up my contract as well. Funny thing is, when I picked up the truck and signed the original contract, there was only a $1000 rebate. When I went in to re-do the contract (sign the second one), Chrysler had upped the rebate to $2000. I insisted they give me the extra $1000 since it had been inacted during that time between contracts. They were not happy about it, but they had no choice. The gave it to me and I made an extra $1000 off of their mistake..
Since the numbers aren't carved in stone yet, you can re-negotiate everything if you want to be forward enough.

Message: So far the dealer isn't budging. They say Chrysler Financial sent this contract back, so there's no way to fool Chrysler into re-dating the contract and getting me the extended warranty. I haven't signed the new contract yet. But I'm not sure what type of credit damage I would incur if I played hardball and let them take the QC back if they don't budge on the warranty.

Message: You bet! Have "your attorney" give the dealer a phone call, maybe followed by a letter. Might be a good couple of hundred (or less) dollars invested. Sounds like the dealer is possibly between a rock and a hard place, but it takes an attorney to review the paperwork to be sure. Your modest request in order to bail him him out works for me.

Message: It's amazing how cooperative and groveling a retailer becomes when you say "Guess I'll just have to put a hold on that with the Credit Card company". This situation sounds somewhat similar even though it's their finance company, not yours.
They screwed it up. If there's no valid contract, there's no contract. If they want the truck back, fine. You can cut a better deal today than 6 weeks ago, and any decent lawyer can cover your tracks. I'll bet they compromise, and pay your lawyers bill as well. They are not used to 2-way hardball.

Message: The beauty of this one is that ALL the paperwork is theirs, as is the finance company. The buyer is not an expert on their paperwork and he relied on their expertise to do it all right. They did not. No contract, IMHO. They own the problem.

Message: I do think it is important that the November 20 payment be made on time, unless the lawyer says otherwise. The buyer has to show good faith throughout to protect his virtue as the victim. Plenty of time between now and the 20th for the lawyer to intervene.

Message: this happened to me.if the dealership doesn't get correct contract they will have to pay a fine.you got them bt the balls,i got them to take $5000 off my truck.this is a a beutiful situation that your in take full advantage of it.

Message: No budging from the dealer yet. They're saying if I don't sign the new contract, they'll repossess and charge for the current mileage. Doesn't make sense to me, because I could do that, pay the mileage charge, buy the truck again with the warranty and be money ahead. Of course my credit rating will probably go to hell and I'll be screwed forever.
I sent all pertinent info to my lawyer, and we'll see who blinks first.
