Well normally I don't like to spread bad news about companies, but on this occation, I feel it's justified. Here's the scoop. Last Wednesday afternoon, my son and I are headed to a rental shop for boom lights we needed to pick up. Truck dies with me going down the road, so I bump tranny up in neutral, start the truck back again, yep the MIL was on, drove fine the rest of the way there. Got to Sunbelt, took care of the money stuff etc etc, got in truck to crank it and move over to hook up the light tower, and truck doesn't start. Have truck towed the the local 5 star dodge dealer near me Thursday morning, no biggie, Friday call me said they found the problem, bad cam sensor, truck would now crank when not hot but would not rev over 3500 in any gear, part be in on Sat, Monday tech would install and get truck back to me. Monday 11:05 a.m get the call truck is fixed, then the guy says um but we have some bad news tho..... seems someone has stolen your radio(was a Kenwood Excelon) so I'm mad at that point cuase guy says looks like that's all they took. I get over there.... all they took I asked him, both my amps were gone, the DVD system gone, and right at 200 cd's and dvd's. After the owner of the dealership telling me since this was the first time I had ever done business with them, tough, he wasn't going to do anything about it. After he realized that no way in hell was he going to throw me out of his office... they agreed to pay my deductable on my insurance... so guys and gals beware if you live in the north georgia area, and deal with a certain unFAMILY dodge dealership... be forwarned!

yea the owner thinks I'm some piss ant and don't know any different, he doens't realize we've owned our own business for over 20 yrs and I KNOW if a customer drops something off at my shop, like it or not, if something happens to it while it's on my premises, too bad for me, EXCEPT, when there are physical signs of forced entry, which my truck showed no signs of, NO broken window, no slim jim marks, nothing, someone knew what I had in there, picked up my key from whereever they had it and helped themselves! OH well, my insurance is going to pay, but they are going to turn around and go back on him for the reimbursement....

good that they should turn back on him for the $. he shouldn't get to avoid paying the bill just because you have insurance. most states, not sure about georgia, have a collateral source rule which prohibits that. whatever happens don't let your insurance company hike the rates on you. that dealer should be fully responsible.

Not too piss on your parade, but all dealerships have a policy of "NOT RESPONSIBLE FOR ITEMS LEFT IN VEHICLE".

The signs are usually posted in the waiting room, the service area, the cashier's desk, pretty much everywhere around the dealership.

Doesn't matter how many signs they have around, they are still responsible by law. Just like if you have a "Beware of Dog" sign and someone gets bit; you are still responsible for your dog, even if some kid jumps your fence! Dealers just want people to believe they aren't responsible so the customer never follows through with legal measures. Ask any lawyer, the dealer should have to pay "out of pocket" everything that is missing. If you hire a lawyer, you can sue for legal fees also.

The "ITEMS LEFT IN VEHICLE" seems to apply to loose items/wallet/change. But if someone uses TOOLS to remove PARTS the dealer should be liable... customers have a expectation of safety for their cars left at the dealer. Thats almost like me taking a ram with leather seats for a test drive and bringing it back with cloth seats-- then telling the dealer they should have not left the leather seats in there.......

Loose things, it doesn't matter, they are fully responsible by law UNLESS there is signs of break in, which my truck didn't show any signs of. Point is they are fully responsible for it but they do not want to take the responsibility and that's fine I know I'll never go back to them ever again. And yes all dealerships MAY have the NOT RESPONSIBLE signs, but how would I know, the truck was dropped off by the tow truck not me 1st and formost, and secondly, they(dealerships, shops etc etc) put those signs up simply to try and discourage people that have things stolen while the vehicle is in the shops posession from making the dealership/shop pay up, that's what the insurance they pay is for. I don't sell cars but just do to the fact that our business is where people drop equipment off with us to be worked on, we have to have liability insurance to cover stolen/damaged issues.

Here's an interesting fact.

Yep. No argument.

Post a "NO TRESPASSING" sign. Guess what?? All legal actions they could have taken against you were just struck null and void - By trespassing on a POSTED no trespassing area.

Yes, I have no argument with the f-ed up situation.

Dealerships get routinely vandalized. This is WHY they post the "items" statement.

By them posting the statement, they can "claim" you were aware of it. You're right, you CAN claim legal fees. No one ever gets them, but you CAN claim them. Hire a lawyer, throw a couple thousand in the sh*tter, get reimbursed for your loss....and you'll be lucky if you break even.

Not trying to be rude, this is what happens.

Question - Did you notify your insurance company of the modifications to the vehicle PRIOR to this incident? When you do this, they will normally take pictures of any custom work and keep it on file, along with copies of all the receipts for the equipment that was installed.

They have specific paperwork that is intended FOR customized vehicles. Anything put into your vehicle that was not OEM is considered "customizing".

Just some info from many years of experience in these matters.

To answer a couple of your questions, the insurance companies are fully aware of what's missing, and have already submitted the paperwork I'll have checks be wk's end. Sue the dealership? Nope I won't waste the time to do that, but will I have my attorney send him a couple letters? absolutely, I am in this instance IN THE RIGHT according to Georgia Law, I knew I was in the right as soon as the arguement started, my attorney assures me of this and so does both insurance companies and between the 3, since they are all in agreement, I'll take their word on it. Rest assured I wouldn't go all the way to court on this, this I guess you could say has turned more or less into a pissing contest, be thinks he's some big shot, and I'd like to bring him down a notch or 2. But I don't intend on sueing..... that's, in my opinion what's wrong with the country now.. everyone's sue happy. I justed wanted the man to take care of the situation, instead he TRIED to treat me like some kind of piss ant.

Sorry to hear you got ripped off this is why I do my damnest to not leave a vehicle over a weekend at a dealership.
If I do I insist on them putting it the shop on the rack just to be safe...
Just out of curiosity, aside from the theft aspect, how was the service?

When you dropped off the vehicle, did you lock the doors and give them the key? If so, and there was no sign of a breakin, then the dealer IS resposible beacuse THEY left the vehicle unattended with the doors unlocked. You did your part, Tell your insurance company to cancel your claim, you are going to make the dealers insurance pick up the tab.

why would you do this? Becasue insurance companies are all about risk. You are a higher risk now that you have a claim and your insurance company CAN raise your rates. So even if they picked up the deductible, you can still get screwed by higher premiums.

It's like slipping on the ice walking on the sidewalk at the grocery store in winter - the grocery store maybe liable. Public places such as grocer stores, dealers, etc need to be make a "reasonable effort" to protect you and your property.

also, file a complaint with the BBB and write a letter to the editor of the local newspaper, noone likes bad press.

I know nothing about the legality of your claim against them SO Im not here to comment on that aspect. I am gonna comment though on the fact that it sounded like he would have done something for you, (made things right) If you had been a Regular customer. SOrry This if your 1st time here. we can screw you over!!

Anyone know where I can buy a Kenwood Excelon radio with amps? Just kidding..man that sucks. I agree with the guy that said he never leaves his vehicle over the weekend at a dealer but you had no choice in this matter unless you towed it home. If they treat you like a piss ant, expose them and make sure everyone knows how they treat "unregular" customers. If that's how they treat people who are first time customers, who in the hell would go back?
