Subject: Is my 2000 Dak a legit lemon?!?

Hello all.
My 2000 Dakota, 3.9 has 48xxx miles currently.
on 08/07/02 it had the crank seal and timing chain cover replaced by dealer 1 because it leaked.
Then on 04/28/03 with 30081 miles, by dealer #2, the seal was replaced again because of leaks.
Then on 8/26/03 with 33910 miles, by dealer #2, the seal was replaced again because of leaks.
2 days later, 8/28/03 with 33947 miles, dealer #2 replaced the front seal and timing cover because it still leaked.

And now yesterday, with 48xxx miles on it, I noticed its leaking AGAIN!
This would be time #5, even though im past the 3 year, 30k miles, should be still be fixed for free? Is this truck now considered a lemon?
Whats the deal?

depends on how the lemon law is written in your state. i think for most it's 3 trips in to repair the same exact problem without a remedy.
sounds like you might qualify. i am assuming when you say "front seal and timing cover" that they are just changing the timing cover gskt and front seal. and it's probably a warped timing cover or bad harmonic balancer.

Yes, they replaced the balancer, timing cover, front main/crank seal, basicly everything that had to do with that location on the 4th time.
It probably has been leaking for some time, I havent checked because I assumed it was taken care of, but I dropped a nut under the truck yesterday and thats when I noticed it.
I will call the dealer and see whats up.

Any one else care to comment feel free!

It's not a lemon as it's 5 years old and will no longer qualify as a lemon anywhere. Check here

Find a good mechanic (rotflmao) and have the problem diagnosed and fixed. Obviously the seal is not the problem, something else is causing the seal to fail. Most stealership chimps have a hard time putting air in the tires let alone really using their brains to properly diagnose a mechanical failure.

If your oil pump is putting out high pressure it can and will blow out either the front seal or rear main. It's not common, but I have run across it in other vehicles in the past. If the pressure regulator spring in the oil pump gets broken or stuck it will cause very high oil pressure and will blow out the weakest seals which are usually the front or rear crank seals. Have your mechanic do an oil pressure check. Don't just go by the gauge in your dash. The only other thought I have is the possibility of the previous mechanics just not doing a good job, but that seems kindof odd to get that from two seperate garages.

should have reported it to the bbb. before the warranty ran out. had a similar prob. but on a chevy. dealer replace shifter parts 4 times within one year, i asked if they would be replaced free after the warranty ran out because they had not fixed the problem, only temporaly band-aided the prob. they told me the would replace for free untill the warranty ran out, after that i would pay the cost. Knowing the problem would occur again, i contacted the bbb. it did not qualify for "lemon" law in NC because of the miles, however, a few calls from them and Detroit executives called me to resolve the matter. 1st offer was 1000 mile extended warranty, did not accept, 2nd offer 5000 mile extended warranty. after explaining to them the problems in detail and them researching the vehicle maintenance records at the dealership, the last offer was accepted. brand new transmission and 15,000 mile extended warranty..NEW transmisson was installed, my old lady traded the car in 3 days later....

It's rare but the shaft that the balancer rides on could be out of round (not straight) a manufacturing flaw of the crank. It happens, but only a good dealer will go that far. They have to call the companys techs and get them to comfirm their diagnosis, and they get drilled with questions,did you check this ,did you check that, Most of them are afraid to call because they overlooked somthing else. So you get stuck because of their ignorance. Not all but some
