Hey all,

remember me? I posted about my truck being stolen with all the valuables in it. well , they found my truck., and all i can say is that i hope the thief got some good money for all the body parts and engine(67,000 miles).. The insurance company is cashing it out to me. I thik i'm getting jiped.They are only giving me bluebook around $6500 or so. i guess i can buy another guitar and make A GOOD DOWN PAYMENT on another truck. I've been thinking about a Tacoma. I dont pull anything heavy so a 4banger will probably be pretty good to me.

well, I hope that you guys stay happy with your Daks and i hope you keep setting your alarms.

you dont have to take their 1st offer. do a little research, find out what comparable trucks are selling for in your area (you may or may not do better than $6.5K, but at least you'll know if the offer is fair). then tell them what you want...

if they don't satisfy you just say "see you in court" they are hoping that waving some cash in your face will make you jump. they figure you won't go through the trouble of taking them to court. It all depends on how much energy you want to put into this...

Spending money on lawyers over $6500.00 seems silly. I think the part about the Les Paul and all the other stuff was just playful B-Sing. It depends on the fine print in your policy regarding valuables in your vehicle. Alot of comp policies cover only the vehicle, not the contents.

Sux that you are in this predicament, though. Can you buy it back and fix it or is it completely a mess?

If your a homeowner or have renters insurance the contents of the truck should be covered by that policy.
Unfortunately lawyers get about $200 an hour to represent you win or loose the billable hours maybe more than most people can afford. I'm sure even if the lawyer negotiates "high" book you'll still loose after billable hours. Not to mention the insurance company can withhold payment of any kind until after the court decision with can take years.

My 97 Nissan PU was totalled by someone who ran a red light. Their insurance company only offered me book value for an average 97 Nissan PU, despite my extremely low mileage, and despite the new all terrain radials I'd bought five months before. I was extremely upset not only at the offer, but the fact that I had zero bargaining power against them. My own insurance agent recommended I take their offer, because even if I did get a lawyer and go through that mess, the courts would only require that they pay me industry standard, which is what they offered.

Sorry about your truck being stolen. I don't mean to be a downer but that was my experience. My truck was gone, and I got jipped. Insurance companies are in the business of making money for themselves, not protecting you. I heard it said on a tv show about hurricanes and home insurance -- insurance companies don't make money from your monthly payments.. they make money by denying and lowballing claims.

i dont think 00dak was seriously saying take them to court... i think that he was saying bluff them and see if they call your bluff. I bet ya could just say the word lawyer and get another $1000 on that $6500.. at the same time that you dont want to pay for a lawyer, either do they.

the contents inside the truck were not covered and due to the fact that i'm only 19,and the truck is in my moms name, and still living at home i don't have a chance of getting anything more than what they want to give..

All i got to say is you all must have some cheap azz fly by night insurance companies. State farm has went to bat for me on 2 seperate incidents and i never got screwed. I guess you get what you pay for.

yes, bluff them. just asserting your rights a little will get you more coin. In any business deal invilving negotiations - you never take the first offer.. the insurance co really doesn't expect ypu to anayway, they win big if you do, tho. there's another $1000 in there if you make your case, show them you aren't a pushover.

by the way if you cash the first check they send you , its over. the fine print will say that if you accept the check, thats the final settlement

Where was the truck when it was stolen? You may be able to make a claim for the contents under your homeowner's insurance.

ripped off 2, if you think it's worth spending $1500.00-$2000.00 at the very minimum to get another g-note out of the insurance company, mo powa to you my man. And don't forget about the 30% lawyers typically take for all winning claims.

To me that's spending your way to poverty.

The insurance companies don't hire lawyers on a per case bases like we do they have lawyers on payroll so it doesn't cost them to use them. I may be wrong but I believe lawyers get 1/3(and up) on liability (injury) claims only the rest are based on billable hours.

Check the limits of the small claims courts where you live. You will not get anywhere trying to "bluff" them, they will tell you to go ahead.
Take their check, do not cash it and file in small claims court. You will need evidence of the value of the truck. Locate others with similar milage, options, condition, etc. You do not need a lawyer.
I had an experiance a couple of years ago when a guy passed me on the interstate. When he pulled back into my lane he lost part of the load in his truck. His insurance co. would only pay for aftermarket parts. I filed and the day of the hearing they called me at 8:00 am and wanted to settle. I got the full repair cost paid.
