Subject: ran into the 1ts owner of my truck!

the good thing about the whole thing is he took good care of the truck!he used synthetic oil from day one,i looked in the manuel when i bought it to see if it was taken care of.
the bad news is that he turned the truck in with 85,000 miles and i bought it with 53,000 miles!
decker dodge in hawthorne new jersey is in for a suprise when i show up with both milage statements!
i was told that it is a secret service deal and
odometer fraud is subject to jail time!
what is your guys thoughts so i am prepared?

Just out of curiosity...how would they go about rolling back the odometers on the dakotas? I don't want a how-to (duh), but do they have some kind of a tool that changes it through the PCM or what?

easy to do with the right equipment to reset the pcm.

rumor on the street, it costs $300, but the dodge team could do it for free.

carfax is overrated or overadvertised ( a sucker bet) , it would show car went from one owner with zero miles to new owner with 53,000 miles.

carfax is pretty much a joke, accuracy about 25%

Get a lawyer and take the police with you. You probably will need to file a complaint and swear out a warrant on the salesperson that sold the vehicle. You are in the driver's seat on this one unless they have a VERY convincing explanation of the mistake. The court will not be very understanding of the explanation no matter what it is.

I do work on Chrysler consoles and In-Car Computer systems. You can pay some crook to reset your comp to fudge the odo to read whatever mileage you want. But all chryslers have 2 backup systems. One of them is a mechanical tick counter which uses the transmission and driveshaft to measure approximate mileage. The other system is a second computer which keeps track in a subsystem area. Both are designed to back each other up and the dealership does check them when they accept a used car and after a lease turn in. Some may not depending on who they have on staff. This system is fool proof and hasn't been fooled except for dealer error. You could pay to have it done, but you will eventually get caught if someone cares to check. Run this risk if you want, its not worth the risk that you are taking!

I knew it was possible because I remember reading that some dealerships can do it only under certain circumstances where it would be needed. I can't remember any examples but I'm thinking maybe if you got a new PCM (if the main odometer reading is stored on it?), they program the new one to match the mileage on the old one, and stuff like that.

Also...like shh said...Carfax isn't all that it's cracked out to be. It's only as good as the person reporting wrecks, changes of ownership, etc.

folks think carfax shows major rebuilds

NOT - only if title changes as a salvage

I can think of a couple of cars that the rear was pushed to the back door, front end pushed to front door and carfax is clean. Only parts of the cars not repainted was the door insides

My advice... go in with the paperwork, show your hand, and tell them you want:
1. a big refund check for at least half the purchase price
2. the odometer fixed to reflect the actual mileage
3. a written statement from them that they detected the error and corrected it.

The 2nd and 3rd items are for your protection should you resell the vehicle. There may be some paper work with your state's Dept of Transportation (or whatever govt office does titles). Have them get that all straightened up. Let them word the statetment in #3 such that it gives them the opportunity to "come clean" and save face. You know "Oops, we messed up and wanted to let you know we will correct it" rather than something where they admit guilt like "we tried to shaft you and you caught us".

If they do NOT want to work with you, do NOT let them keep any of the documents and tell them you'll be contacting an attorney and your states vehicle titling agency to report Odometer fraud.

Don't go in all accusatory... there might have been a legitimate mistake somewhere along the line. Just start of pointing out the mistake and saying that you expect them to make it right.

Oh yeah, and saying that you are active in the internet community and have mentioned this, and hope to tell them that "so and so dealership made good" might be helpful.

I have to agree with PLarkinJr on this one.

If you go in all pissed off you will just put them on the defensive.

I seem to remember this happening to a friend of mine a few years ago. the truck had 125000 miles but only had 5 digits on odometer. (ford truck mid 80's) The truck was sold to him as 25000 miles. He found a sticker inside the air hat to change the air filter at 128000 and took it back to the dealer ship.

They made it right for him if they don't offer to make it right for you then call in the big dogs. but as PLarkinJr stated, keep all copies of documents and it might be a good idea to record the conversation. that way if they try and change their story later, you have proof.

I have to think that given the opportunity to "save face" they will take it. But if you put them on the defensive they will just try and discredit you. Take the high road and give them the benefit of the doubt, and if they try and screw you, let them have it...just make sure all of you ducks are in a row before the first confrontation.

digs out his paper work.
real nice guy traded his 98 club sport (now mine)in 99 for a 00 quad and he just hit 110,000 miles on it.
he travels to canada alot.

Dead on Kowalski! Don't give/show them your origionals, heck they have thier own origionals to reference. Show up with 2-3 copies so they know the documents have been duplicated.

Mr. Sleppy, So an unscrupulious dealer could turn back the odometer to make the truck "look" like it had low miles when in fact the other systems in the truck would tell another story, right? Would this throw codes, or just be accessable when a dealer runs diagnostics?

Bringing along a witness (friend, relative) might not be a bad idea incase they try and pull any funny stuff. It would be better to have someone backing up your story than to get into a he said/ she said battle.

DSW- The dealer could try to alter the code to make the odo read a different mileage. Problem is that this is a tri-level security system. The mechanical counter on the trans/axle will always read correctly as there is no way to turn it back without breaking it. Thus causing you to automatically doubt the mileage. Any dealership will check all 3 of the systems without telling you, and will only publically acknowledge the odo as the source. A crooked dealer could altar 2 of the 3, but a simple trip to another dealership would reveal it if you asked them to "investigate through more reliable systems". The 3 system setup was designed to keep even the dealerships from cheating you. Since the penalties are so high for this sort of behaviour you will almost never catch a dealer doing this. In the private sector and B dealers might try this, but if you catch them, you might win a big settlement. Not worth the risk but there are still idiots and crooks out there.
