Message: could you go to the dealer manager and say "look, there was a big complication, i feel very cheated and taken, legally it could get very ugly...." and see if they'll throw in bigger wheels or flares or whatever and call it even.....
they may give you that to make you happy.

I have already tried that yesterday and they said listen "you bought what you bought" Which I didn't...I bought an SXT and got a base model Sport.
Anyway the BBB is handling my claim and I got an email from them this AM telling me they were in the process of contacting BJ Motor Company the dodge dealership where I bought the truck.
Hey I like everything about my truck, I just feel they sold me something on a false statement and claim.

Message: Johnboy, your example uses KNOWN items. Do it this way...
If your furnace repair man told you that your flux capacitor is broke but it's cheaper to buy one yourself, and says it's the 1346-9 unit. You go to the flux capacitor store and see a device laying there with the label "Flux Capacitor, model 1346-9". You ask the salesman if this is a model 1346-9 flux capacitor and he says yes. You pay for it, with again the receipt saying 1346-9 Flux capacitor.
When you get home the furnace guy says "what the heck! This is a 1329-5 capacitor, it won't work!"..
Should you have the right to return it? Were you done wrong by the flux capacitor store? Did THEY mislabel something???? Yes to ALL of these things.
Dodge may not have put the SXT stickers on the truck, but THEY put SXT on the BOS, so that places it on them once again.
Dog and cat, sheesh, no wonder you think Lewis is being an arse, you aren't comprehending! He DID NOT KNOW WHAT AN SXT WAS, only that it was supposed to be a better package.

Message: IMHO you have a good bait-and-switch case if they *listed* options that the truck doesn't actually possess. If on the other hand you *assumed* the truck was worth more because they referred to it as an SXT, you're probably SOL.
CarMax sold me a SportPlus that they referred to as an SLT. I couldn't care less that they got the model wrong, because the truck had exactly the options they said it did.

Message: Lewis, what did the BBB say they were going to do? From what I understand they are out to protect consumers by putting a black mark on suspicious businesses with poor business practices. But then again, does the dealer care that the BBB is involved? Who checks with the BBB before they buy a car? Not many people. Are they going to fight with the dealer to get the problem resolved?
Try contacting your states Attorney General to see what they can do. This might put some pressure on the dealership since they don't want to be sued and have it printed in the news paper that they were sued for selling a vehicle fraudulently. You might be suprised to find that there are other people in the same situation with this dealership.
Honestly, this is a car dealership and they are used to screwing everyone who walks through their front door. It's going to take alot of effort to get what's coming to you. It would be nice if you could turn the tables and put the screws to them.
What are the options to rectify the situation.
1 - Refund the purchase price, all fees, tax and license. Forget a mileage deduction, they made the mistake.
2 - Refund the cash difference between a Sport model and the SXT model.
3 - Put the accessories on the truck to make it look like a SXT, tires, rims, fender flares. I love this one, since it will make the truck optioned like an SXT and cost the dealership a bunch of money.

Message: That's exactly right guys..I had no clue what the SXT package was, just that the dealer told me and put it in writing on the BOS that I was getting a 2002 Dodge Dakota SXT. In his words..."you are getting a truck with a better package than the base Sport on our lot now".
The BBB has contacted BJ Motor Company and once they get a reply the BBB will get back with me.
And yes I have printed off the form to fill out for my Office of Attorney General in Virginia.

Message: I think the bottom line here is that the dealer engaged in an unethical business practice. Some of you may be able to place some blame on Lewis, but not everyone is a car expert. Just like not everyone is a television expert, a computer expert, of a "flux capacitor" expert. We rely on others to help us in purchasing something that we are not completely familiar with. For instance, if the dealer tells you that you have a hemi in your new ram, the paperwork says hemi and the truck says hemi, then the truck should have a hemi and all the proper hemi components. Not a 5.9 with an airbox that happens to say hemi.
The dealer shouldn't take advantage of this, and if you chalk it up to "let the buyer beware" (even though I think having it in writing is about as good as you can get, ie: SXT on the BOS)then they will continue to rip people off. Good business practices should be rewarded and unethical practices should be punished.
I'd be willing to send BJ Motor Co an e-mail letting them know that I have heard of their response to Lewis' complaint and I disagree. I can't find an e-mail address or an 800 number for them. Good luck Lewis, I hope you can make them pay.

Message: If the contract you have for the truck says SXT, but the VIN says Sport, that is fraud!
The dealer is reqiured by law to settle this to the customer's satisfaction.
If the dealer doesn't, send a certified copy of the contract (be sure it contains the VIN) to your state's Attorneys General office, with a copy to the dealear. This might get their attention.
Before you ask, I was in a similar situation a few years ago.

Message: A few people on here are right. It doesn't really matter what the salesman said, he's a salesman. It all comes down to the paperwork. If the paperwork says SXT but the vehicle is actually a sport then you have a legal issue. If it says sport then there is nothing you can do. An oral contract is pretty much worthless, it's what is in writing that counts, otherwise it's a he-said she-said thing - you can take that to court, but you may lose and wind up paying lawyer and court fees.
Now if the salesperson agrees and said that it was an SXT, then that case it can be whole different ball game - it will still come down to the paperwork. However a reputable salesperson would do whatever to make it right.
Sales people sometimes don't tell the whole truth, there's nothing much you can do about that.
