Subject: speed ticket IP: Logged
Message: so i got a speeding ticket a little while ago, pretty bad, 63 in a 45 work zone. well as you might have figured it wasn't fair, but i guess thats irrelevent. i just want to know if anybody really knows how to fight a speeding ticket or if they know a site with FREE information. all the sites i find want me to buy their stupid book. yall have a good day and for god's sake, don't drive with the flow of traffic

Go to the National Motorists Association website for help with fighting tickets.

Message: It really all depends on your local municipality and how they work,,,,,,,,but each and every time I have plead not guilty, then went to court and spoke with the prosecutor, the ticket has always been reduced to a lesser point value or a no point value and just a fine. Chris

Message: just got one going 75 in a 50, will go to court never no what will happen there. Haven't had a ticket in 5 yrs. they take that into account.

Message: Do like Chris Allen said, and dress to impress. The only way to beat a speeding ticket(assuming radar/laser) is you have to prove the equipment is out of calibration or the user was not qualified. Pretty much a fat chance on both.

Message: Find a cheap lawyer and pay em way less than you would have to pay for the ticket and let the lawyer do everything for you...he'll more than likely convince them to take it off your record if not drop the case entirely.
Like that one guy said get a radar detector I got one after I had gotten 8 tickets and haven't gotten one since...should've gotten one from the very beginning

Message: I'm not saying i'd do this....not saying it's worked for 4 tickets.....but if you over pay your ticket by a couple of bucks the state has to send you a refund check for the amount you over paid. The final transaction can not be processed until you cash that check. The Highway patrol will have a record of you getting a ticket, but the important thing is that the DMV will not have a record of it. Fortunatly the insurance companys get their driving record reports from the DMV. Pay a little more, insurance stays low, record stays clean. Not that anyone should actually do that....

Message: In Texas, traffic fines are doubled in a work zone when workers are present, and you cannot take defensive driving to dismiss the ticket. I have worked with a road crew in a construction work zone, and I hope they don't cut you any slack. Its sounds blunt, but I have been behind the orange barrels.

Message: stuarth, fines double in work zones period here in kansas. even though there hasn't been a worker on this site for over 6 months!!! the part of the deal that gets me is that i was geting passed on the right by an old ford pickup as the cop pulled me over. the only reason i got pulled over is because of my car with tinted windows. which according to the police officer are also illegal and i must appear in court for that too. and it was a sunday about 6-7 pm. even if they were working on it there wouldn't have been any workers there at that time. and don't tell me about working behind the orange barrels because thats what i'm doing this summer in a town full of the worst drivers in the world. i like that idea about overpaying the ticket by a couple of bucks though. but i don't think i'll try it ;)

Message: kyle...the over paying thing...complete bs.. thats nothing but an urban legend....now for the ticket..go to the courthouse and file a motion for discovery to see if the cop was qualified on the gun and to see if the gun was calibrated and by who, also if the place that calibrated the gun is certified to do so...now plead not guilty, seek as many continuances as you can and if all else fails plead it down.........

Message: Make sure you first go to an informal hearing. If the cop doesn't show, you are a free man. If the cop does show up and the judge or magistrate rules against you, you then have the option of appealing to a formal hearing. Do this. This provides another opportunity for the cop not to show up. Also, right before you are scheduled to appear in court, call the courthouse and tell them you need to reschedule the hearing for a later date. Do this as often as the law allows. The longer you drag this out, the more likely the cop won't show or will have a less than perfect recollection of the incident. One of my former coworkers delayed his traffic ticket hearing for 12 months.

Message: The idea of delaying and opting for as many continuances as possible is a good idea. But just another thought. The same people who do this are probably the same people who continuasly complain about how the court systems don't work, are too delayed,& takes too long for justice when a crime does happen to you. Just keep that in mind whenever you request all those continuances. Also, please don't be the knuckle head that request all these continuances, and the one time that the prosecution request one (after you just filed for 3!) to scream that you have a right to a speedy trial!!!!!!!!!! (Can you tell I have spent way too much time in the courtrooms?)

Message: I got a speeding ticket in my other car going 130 in a 65 not very good to do.I showed the trooper a PBA card and he gave me like 89 in the 65.I ended up going to court with a lawyer and he asked for verification that the gun was calibrated with in a certain time period and he did not have those papers.....dropped the ticket.but this is differtent in every state.

Message: I got 2 tickets in 4 days (bad week.) Doing 41 in a school 20, then a 65 in a 50. Went to court, had a clean record, and had the higher speed one dismissed and put on probation for 90 days for the school zone. Paid a $150 fine (way cheaper than paying the tickets themselves.) I avoided school zones after that like the plague.

Message: 63 in a 45, and then hearing about 41 in a school zone, those of you that are looking to "beat" the rap.....take a deep breath and clear your heads. I don't know about your Dak's, but my 2000 and my '03 have a speedometers, try keeping an eye on it. We all like to wring them our once and a while but use a little discretion where and when, and IF you get nicked for speeding stop the whining and take your medicine.

Message: I will stop whining when speed limits are RAISED to reasonable levels. The max legal speed in many states is only 65. 35 years ago, many of those same states had 70 or 75 limits (that was back when cars were "unsafe"). If cars are "safer" now, we should be able to drive 85-95 legally.

Message: Cars are safer than 35 years ago and some drivers are better, but as a whole lots of drivers don't belong on the road in the first place. Now allow these people to incerase thier speed and you increase yours and you both meet, no matter who is at fault, your both will be dead, even if you don't "buy the farm", you more than likly be one of the vegetables in the garden. As far as the city driving, there is NO excuse to be speeding in a school zone. Weather you agree or not, roads are engineered for a set rate of speed, and the limits are set not only for your protection but for the poor dumb sh*t coming the other way when you loose control. You want to see how fast you can drive, go to the track!

Message: If somebody cannot handle driving a car at freeway speeds, that person should NOT be allowed on a public road. It is the job of the DMV to revoke that person's license.
Who said raising a speed limit means you have to drive faster? All freeways have minimum and maximum speed limits. There is no law that says you have to drive at the maximum speed posted.
If speed kills, why are freeways the safest roads (high speed limits) and city/suburban streets the most unsafe roads (low speed limits)?

Lets answer this question. Most people drive at least 5 – 10 miles over the fastest posted limit.

Lets answer this question; on “Freeways” you don’t have the hidden streets that people come out on, Stop lights, pedestrians crossing the roads, this list can go on forever.
Well ZZ, first question would have for you would be, How old are you? Do you know why the speeds were lowered? I’ll answer the second of my questions for you. The reason the speed limits were lowered was due to the gas shortage of the early 70's, and one of the by-products of the lower speeds was the death rate was also lowered. Yes today’s vehicles are safer but not indestructible. You have a mix of older and newer vehicles on the road and when you mix multiple types of vehicles and different types of drivers you get an unsafe situation. I sit around trying to think of ways of making my truck faster but not so I can terrorist motorists. There are places to go fast, legally, you just need to look for them. Just because automakers build power to give good acceleration (or not so good acceleration) is so you can get up to speed quicker making the transition for stopped to freeway speeds quicker/safer. I will admit that some manufactures do it for the speed but speed is another by-product of power. There are speed limiters on vehicles for a reason but I bet you are one of those that try to remove them, I too would try to remove the limiter (if I had one) but I would still be smart enough to maintain a reasonable speed on the highways. I apologies for such a lengthy response to ZZ comments but miss informed as people seem to be on things that are common knowledge aggravate me to no end.

Message: You ever heard of Germany? No speed limits on the Autobahn and a lower fatality rate compared to US freeways.
The 55 speed limit did not lower fatality rates. If YOU were old enough to remember, many people could NOT buy gas during the first energy "crisis". If you can't buy gas, you can't drive. If you can't drive, you can't be in a traffic accident.
Why did freeway fatality rates DROP after freeway speed limits were raised back to 65-75 in the mid 90s? The government says last year was the safest year on record for motor vehicle travel.

And yes Stuarth, I'm in Tx also. Watch out for I-37 south of San Antonio, I got a speeding ticket for 76-70zone by DPS Trooper, Chalked it up to experience, Paid my fine and learned from my experience.
I only have 1 suggestion... SLOW DOWN!
